Assessment of real estate or other property is a very complex process. A specialist who determines the adequate market value of the object and advises the owner about the possible price of sale is an appraiser. In accordance with the modern legislation of Russia, for the implementation of such activities, it is necessary to be a member of one of the SRO of appraisers. The entry into the SRO is associated with the payment of the contribution to the compensation fund of the self -regulatory company, which is equivalent to liability insurance. In case of appeal to the court of the client, who was damaged by the incorrect assessment of his property, and the court made a decision on compensation for losses, the payment should be carried out from the compensation fund.
Prior to the adoption of the law on the SRO, the activity of appraisers was carried out on the basis of a license. Currently, licensing is replaced by membership in the SRO of appraisers. At first, this caused a misunderstanding by representatives of the profession, there was an appeal to the Constitutional Court regarding the legality of coercion to join some society. In addition, there were opinions that there were no precedents of court claims to appraisers, since their services are consulting, and the final decision on the sale price is made by the owner. It should be noted that this is not always the case. For example, in case of bankruptcy, when the property is seized, it is sold on the basis of the conclusion of the appraiser, and the cases of abuse in such situations are enough. Consultations of the appraiser, unlike the Soviets of relatives, friends and other unofficial persons, are carried out on the basis of an employment agreement or contract, are very not cheap, and the results of the assessment should be justified. When the client is misleading due to low qualifications or other reasons, claims are quite possible.
SRO NP, or self -regulatory organizations of non -profit partnership, created in the Russian Federation for various fields of activity. There are a SRO of Builders, STRs of Refineers and other. For entry into the SRO, not only a cash contribution is needed, but also a reputation among colleagues. After the transfer of assessment activities from licensing on self -regulation, the number of subjects of appraisal activity decreased. It is quite predictable that in the STP with collective liability, specialists with low qualifications or unimportant reputation do not fall. We can hope that self -regulation contributes to greater transparency in this very peculiar complex activity.
